American Legion Riders - Post 87

DEPARTMENT OF ARIZONA

By-Laws

Purpose

To participate in parades and other ceremonies that are in keeping with the Aims and Purposes of the American Legion. To promote motorcycle safety programs and to provide a social atmosphere for American Legion members who share an interest in motorcycles. To use our association to promote and support programs of the American Legion. {The use of the word "he" or "him" in these by-laws is used in its generic term, and is not meant to exclude the female gender.}

BY LAWS

1. Membership:

A. You must be a current member of the American Legion, American Legion Auxiliary or Sons of the American Legion.

B. You must own a motorcycle of a least 350cc in size or be the spouse or significant other of an ALR Association member.

C. The ALR Chapter is sponsored by Post 87, Department of Arizona. All materials produced by the ALR chapter shall acknowledge its sponsoring post and the Department of Arizona.

D. By a vote of 3/4 of the members present and voting, an Honorary Membership may be bestowed upon an individual who has continuously demonstrated his support to the American Legion Riders. Honorary members shall not be entitled to a vote in Chapter affairs nor be entitled to hold an Office of the Chapter, but will have to pay the Chapter dues, will be entitled to wear an American Legion Riders Patch with the approved rocker, and will be entitled to attend all Chapter functions.

E. A person wishing to become a member of ALR 87, and who meets all of the requirements of this section, must submit a membership application to ALR 87 together with the required dues, which will be considered at the next regular meeting of the ALR 87. A majority vote of those members present is required in order to obtain membership into ALR 87.

F. A person who meets the requirements of Section 1 (A), but does not meet the requirements of Section 1 (B), and who supports the purpose and goals of ALR 87, may apply to be a "Supporter" member of ALR 87. The process for "Supporter" membership is as set forth in Section 1 (E). "Supporter" members shall not be entitled to a vote in Chapter affairs nor be entitled to hold an Office in the Chapter, but will have to pay the Chapter dues, and will be entitled to wear an American Legion Riders Patch, provided that a rocker stating "Supporter" must be worn with the patch or the word "Supporter" must be sewn onto the ALR patch.

3. Elections

A. Election of Chapter officers will be held annually at the regular April meeting of the Chapter by a majority of the Chapter membership voting. A member in good standing and participating can vote electronically, sending it to the Secretary by 6pm the night before the regular meeting. The term of office shall be for one [1] year, and shall continue until a new officer is elected for that office.

B. In the event of a vacancy in an Office, the Director shall have the ability to appoint a successor, who shall serve in that capacity until the next scheduled annual election.

4. Duties of Association Chapter Officers

A. Director: Will serve as Chief Administrative Officer of the ALR Chapter and will preside over all meetings. He shall have general supervision over the affairs of the ALR Chapter. He shall perform such other duties as authorized by the general membership.

B. Assistant Director: Will assume the duties of the Director in his absence and Will assist the Director in the performance of his duties when called on to do so by the Director.

C. Secretary: To keep a full and correct record of all proceedings at the meetings. Keep membership records as may be required by the general membership. The Secretary should also give detailed minutes at each regular meeting.

D. Finance Officer: To have charge of all finances of the ALR Chapter. To have charge of disbursing funds as authorized by the general membership. To give detailed financial reports at each regular meeting. (Copies will be furnished to the Sponsoring Post or Department if requested.)

E. Road Captain: Will be the logistics person in charge of organized runs of the ALR Chapter. He will determine dates, times, routes and meeting places for those taking part in a run activity.

F. Sergeant-at-Arms: Will preserve order at meetings and gatherings, assist the Road Captain in enforcing all rules of safe riding during rides and runs; and perform such other duties or chair such committees as may be from time to time assigned by the Director.

5. Meetings

A. Regular meetings will be held at a date, time and place as voted on by a majority of the Chapter members.

B. Special meetings of the Chapter will be held at a date, time and place as determined by the Director or by any two officers, provided, however, that a minimum of five (5) days notice of such special meetings must be provided to all Chapter members.

C. Those members present at a meeting will constitute a quorum.

6. Finances

A. Members in the Chapter shall be assessed $12.00 per year for each member. Dues are payable at the first regular meeting in January of each year and become past due on that date; if they aren't paid by the first regular meeting in February the member will be dropped from the rolls, this includes forfeiting "Charter Member" status. If the member wishes to come back to the ALR, they have to fill out new application and be voted on by the membership as if they were a new member.

B. The initiation fee shall be as determined by a majority of the members present and voting at a regular meeting of the Chapter.

C. Potential new members will not submit dues with member application. Dues will be due when the individual is voted upon by the membership. They will show a current Legion/Auxiliary/Sons membership card upon paying dues to the ALR. The dues will be pro-rated at $1.00 per month depending on month of joining.

D. Nothing herein shall preclude the Chapter from raising revenue from other lawful sources.

E. An officer from American Legion Post 87 must be a signator on any and all ALR Chapter 87 bank accounts.

7. Expulsion

A. Any member may be expelled or suspended from Chapter by a 3/4 vote of the entire Chapter membership at a regular meeting, provided, however, that such member must receive notice of the proposed expulsion or suspension and the reason therefore at least ten (10) days before the meeting.

B. Expulsion or suspension may only be done for good cause. "Good cause" is hereby defined as actions or activities by a delegate whichbring discredit or dishonor to the American Legion or to the American Legion Riders.

8. Disbursement of Funds

A. Disbursement of funds will be only those authorized by a majority of Chapter members present and voting.

B. The Chapter will be a non-profit organization and my only disburse funds in a manner that is in accordance with all local, state and federal laws regarding non-profit organizations.

C. All checks will require two signatures, consisting of the Director and/or Assistant Director and/or Finance Officer and/or Post Officer.

D. Upon the dissolution of the Chapter all monies and assets of the Chapter shall revert to the American Legion Post 87.

9. Committees

A. The Director may appoint such standing or special committees as he shall deem advisable for the benefit of the membership of the Chapter as a whole.

B. By a majority vote of the Chapter Officers present and voting, the Chapter Officers may appoint such standing or special committees as they shall deem advisable for the benefit of the membership of the Chapter as a whole.

10. Patches

A. No patches or insignia shall be worn which bring disrespect to the American Legion, American Legion Riders or American Flag.@

11. Amendments to By-Laws

A. These by-laws may be amended at any regular Chapter meeting by a vote of 2/3 of the members attending such regular meeting, provided that the proposed amendments shall have been submitted to the Chapter members in writing and provided further, that written notice shall have been given to all members at least five days in advance of the proposed amendments and the dates when such amendments are to be read and voted upon.

12. Appointed Officers.

A. The Director shall appoint offices that are empty as needed. The term of office shall expire at the July meeting in each year, unless reappointed in July by the incoming Director.

13. Absentee Voting

A. If a matter needs to come before the membership prior to a regularly scheduled meeting, voting by e-mail shall be allowed, provided, however, that the Director shall provide at least five (5) calendar days notice of the proposed motion via e-mail to all members who have e-mail, and telephone nice to those members without e-mail, on the proposed motion and provide the Secretary with the results thereof. Any member may forward a proposed motion to the Director, who shall then forward that proposed motion on to the membership as provided for in this section.@

These By-Laws were approved by a majority vote of ALR Chapter 87 on the
